On 4 June 2009 Moscow Arbitration Court upheld the claim filed by Protek against Veropharm, the production division of the pharmacy chain 36.6 and its Yekaterinburg-based affiliate Atoll-pharm for the non repayment of debts totalling RUB 32m ($1m). The ruling has not yet been enacted and, the Court is to scheduled to hear the appeal of 36.6 on 10 September 2009.
The claim pertains to a delivery contract concluded between Protek and Atoll-pharm on 1 January 2008, as well as to a corresponding surety agreement signed in October between Protek and Veropharm.
Protek has been in the process of suing 36.6 since November 2008. Since that time, seven claims against Veropharm, totalling approximately RUB 145m ($4.6m) have been lodged with the Moscow Arbitration Court. During the period January-August 2009, 36.6 reduced its debt to the distributor by RUB 500m ($15.8m) to some RUB 300m ($9.5m).
